Terms and Conditions

• Factory: A registered manufacturer or producer that lists products on the Platform for sale to merchants and/or end customers.
• Merchant: A registered wholesaler, distributor, or retailer that purchases products from factories and may resell them through the Platform.
• Customer: An individual or entity that purchases products through the Platform for personal or business use.
• User: Any person or entity accessing the Platform, including factories, merchants, and customers.
• Account: A registered profile on the Platform associated with a User.
• Content: Any text, images, product listings, descriptions, pricing information, or other materials uploaded to the Platform.

3.1. Customer Accounts: Individual customers may register directly. You must be at least 18 years of age. Customer accounts are activated immediately upon email verification.

3.2. Factory Accounts: Factory registration requires submission of company information, commercial license, and relevant documentation. Factory accounts are subject to admin verification and approval before activation.

3.3. Merchant Accounts: Merchant registration requires submission of business credentials, commercial license, and relevant documentation. Merchant accounts are subject to admin verification and approval before activation.

3.4. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.5. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.6. We reserve the right to suspend or terminate accounts that provide false or misleading information.

4.1. For Factories: The Platform provides tools to list products, manage inventory, set pricing (including bulk discount rules), process orders, manage merchant relationships, and track fulfillment.

4.2. For Merchants: The Platform enables product discovery, order placement from factories, storefront management, customer-facing product listings, and resale operations.

4.3. For Customers: The Platform offers product browsing, comparison, ordering, and delivery tracking services.

4.4. Kuwait Market acts as a marketplace facilitator and is not a party to transactions between factories, merchants, and customers unless explicitly stated.

5.1. All orders placed through the Platform constitute binding agreements between the buyer and seller.

5.2. Factories are responsible for fulfilling orders accurately and within the agreed timeframe.

5.3. Merchants are responsible for maintaining accurate product information for items they resell.

5.4. Prices displayed on the Platform are in Kuwaiti Dinar (KWD) unless otherwise stated. Prices may be subject to applicable taxes and delivery charges.

5.5. Bulk pricing and custom pricing arrangements between factories and merchants are governed by the terms agreed upon between those parties through the Platform.

6.1. Factories and merchants are solely responsible for the accuracy of their product listings, including descriptions, images, pricing, and availability.

6.2. Users shall not list counterfeit, illegal, hazardous, or prohibited products on the Platform.

6.3. We reserve the right to remove any listing that violates these Terms or applicable laws without prior notice.

6.4. By uploading content to the Platform, you grant Kuwait Market a non-exclusive, royalty-free license to display and distribute such content for the purpose of operating the Platform.

7.1. Payment terms are as displayed during the checkout process or as agreed between trading partners.

7.2. Kuwait Market may facilitate payment processing through third-party payment providers. Users agree to comply with the terms of such payment providers.

7.3. Factories and merchants are responsible for any applicable taxes related to their sales.

8.1. Delivery terms and responsibilities are as specified in each order.

8.2. Factories are responsible for packaging products appropriately for shipment.

8.3. Delivery timeframes are estimates and not guaranteed unless explicitly stated.

9.1. Return policies are set by individual factories and merchants and must be clearly communicated in product listings.

9.2. In case of disputes between buyers and sellers, Kuwait Market may facilitate mediation but is not obligated to resolve disputes.

9.3. Users agree to attempt to resolve disputes directly with the other party before escalating to Kuwait Market.

10.1. The Platform, including its design, code, trademarks, and logos, is the property of Kuwait Market and is protected by intellectual property laws.

10.2. Users retain ownership of their content but grant Kuwait Market the rights described in Section 6.4.

10.3. Users shall not infringe upon the intellectual property rights of others when using the Platform.

Users shall not:

• Use the Platform for any unlawful purpose
• Circumvent Platform fees or payment processes
• Scrape, harvest, or collect data from the Platform without authorization
• Interfere with the Platform's operations or security
• Impersonate another user or entity
• Engage in price manipulation or deceptive trading practices
• Share account credentials with unauthorized parties

12.1. Kuwait Market is provided "as is" without warranties of any kind, express or implied.

12.2. We are not liable for the quality, safety, or legality of products listed by factories and merchants.

12.3. To the maximum extent permitted by law, Kuwait Market shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform.

12.4. Our total liability shall not exceed the fees paid by you to Kuwait Market in the 12 months preceding the claim.

13.1. You may close your account at any time by contacting our support team.

13.2. We may suspend or terminate your account for violation of these Terms, fraudulent activity, or for any reason at our discretion with reasonable notice.

13.3. Upon termination, pending transactions must be completed or resolved.

These Terms are governed by and construed in accordance with the laws of the State of Kuwait. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kuwait.

We reserve the right to modify these Terms at any time. Users will be notified of material changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
